در تاریخ ۱۹ ژوئیه ۲۰۲۴، دیوان بینالمللی دادگستری (ICJ) در پاسخ به درخواست مجمع عمومی سازمان ملل متحد، نظر مشورتی خود را پیرامون پیامدهای حقوقی سیاستها و اقدامات رژیم اشغالگر اسرائیل در سرزمینهای اشغالی فلسطین، از جمله بیتالمقدس شرقی، صادر کرد. این نظر مشورتی در بستر تشدید تجاوزات اسرائیل، گسترش شهرکسازی، نقض حقوق بشر، تغییر وضعیت جمعیتی و حقوقی بیتالمقدس و ممانعت از اعمال حق تعیین سرنوشت مردم فلسطین ارائه شده است. دیوان با استناد به اصول بنیادین حقوق بینالملل از جمله منشور ملل متحد، کنوانسیون چهارم ژنو ۱۹۴۹ و حقوق بینالملل بشردوستانه، به بررسی حقوقی اقدامات اسرائیل پرداخته و تأکید کرده است که استمرار اشغالگری، ساخت شهرکها و اعمال سیاستهای تبعیضآمیز، ناقض قواعد آمره حقوق بینالملل است. این مقاله در پی آن است تا ابعاد مختلف این نظر مشورتی را تحلیل کرده، جایگاه آن را در نظام حقوق بینالملل بررسی کند و اثرات احتمالی آن را بر روند حلوفصل مناقشه فلسطین-اسرائیل ارزیابی نماید.

On July 19, 2024, the International Court of Justice (ICJ), in response to a request from the United Nations General Assembly, issued its Advisory Opinion on the Legal Consequences of the Policies and Practices of the Occupying Power of Israel in the Occupied Palestinian Territory, including East Jerusalem. This Advisory Opinion was submitted in the context of the escalation of Israeli aggression, the expansion of settlement construction, human rights violations, changes in the demographic and legal status of Jerusalem, and the prevention of the exercise of the right of the Palestinian people to self-determination. The Court, citing fundamental principles of international law, including the Charter of the United Nations, the Fourth Geneva Convention of 1949, and international humanitarian law, conducted a legal review of Israel’s actions and emphasized that the continuation of the occupation, the construction of settlements, and the implementation of discriminatory policies violate peremptory norms of international law. This article seeks to analyze the various dimensions of this advisory opinion, examine its place in the international legal system, and assess its possible effects on the process of resolving the Palestinian-Israeli conflict.
